UN Human Rights Body Enters the United States Healthcare Policy Debate

On April 26, 2017, Dana Milbank, a left-wing pundit at the Washington Post, reported that the Office of the United Nations High Commissioner on Human Rights in Geneva sent a letter to the Trump administration suggesting that repealing the Affordable Care Act (“Obamacare”) would potentially violate “international law.” The Trump Administration could avoid this fate if it accompanied repeal with a substitute deemed adequate by the Office of the U.N. Commissioner on Human Rights [PDF version].[1]

Even by the standards of the United Nations — which we have discussed on site [see blog] — this letter is patently ridiculous. Endeavoring to replace a disastrous piece of legislation to improve the United States health insurance market is hardly a pressing issue for international law scholars and litigators. Furthermore, even a supporter of Obamacare would have to admit that given the myriad human rights abusers in the world [see blog for example], wading into U.S. domestic politics hardly seems like the best use of resources of the U.N. High Commissioner of Human Rights. Even the former President Obama himself never made such an appeal to the best of my knowledge. However, given the inordinate amount of time the Commissioner, Prince Zeid bin Ra'ad of Jordan, spends slandering Israel, perhaps it is an improvement for the Council.

While this may seem like a parody to most observes, Dana Milbank took the U.N. letter quite seriously in his report.

First, he stated, disapprovingly, that President Trump and Congressional Republicans “scoff at lectures from U.N. bureaucrats, particularly on domestic affairs…” The U.N. should be scoffed at on all affairs, foreign and domestic, but I will address that point further at the end of the article. Milbank, an avid supporter of Obamacare, stated that “the U.N. letter is at least a bit of moral support for those defending Obamacare.” Republican efforts to repeal and/or replace Obamacare in the early days of the Trump Administration have ineffectual at best. However, if “those defending Obamacare” need moral support from a virulently anti-Semitic body that does little more than attack Israel on a daily basis, they are in surprisingly dire straits.

Finally, Milbank wrote the following:

“The Trump administration has shown contempt for such considerations by failing to pass along the U.N. letter to congressional leaders.”

The Washington Post was so alarmed by the election of President Trump that it adopted the slogan, “Democracy Dies in Darkness.” Apparently, facing an existential crisis that threatens democracy in the United States, Dana Milbank uses his platform to fret over President Trump not sending the equivalent of an article in The Onion to congressional leaders.

The United Nations Human Rights Council works closely with the U.N. High Commissioner for Human Rights. While the U.N. High Commissioner keeps tabs on U.S. domestic health policy and the Human Rights Council tries to come up with creative ways to lie about Israel, perhaps they could be persuaded to examine the human rights situations in some of its member states. For the purpose of this article, I will limit the list to ten examples:

  • Bolivia;
  • China;
  • Cuba;
  • Egypt;
  • Iraq;
  • Qatar;
  • Saudi Arabia;
  • Tunisia;
  • United Arab Emirates; and
  • Venezuela.

After all of these critiques of the United Nations, we should end on a positive note. On April 24, 2017, the United Nations elected Saudi Arabia to the United Nations Commission on the Status of Women.[2] We can only wonder if Saudi Arabia will use its new platform to advocate for protecting women from driving. There is plenty of room to disagree with any number of President Trump's policies, including his position on health policy. However, in disagreeing or offering a critique of President Trump, one undercuts his or her argument by citing to a ridiculous charade by the United Nations as an authoritative source.

We can only hope President Trump and his administration reassess the United States' relationship with the United Nations going forward.

Updates on Leadership Changes at the CBP

On April 25, 2017, President Donald Trump nominated Randolph D. “Tex” Alles to be the new Director of the United States Secret Service [PDF version]. Although the Director of the Secret Service does not have an effect on immigration policy, the appointment is noteworthy because Alles was serving as the Acting Deputy Commissioner of the United States Customs and Border Protection (CBP), the number two position in the CBP, at the time of the appointment. Alles, a retired Marine Major General, served in various capacities in the CBP beginning in 2012.

With Alles' departure from the CBP, Ronald D. Vitiello is the new Acting Deputy Commissioner [link]. Vitiello joined the U.S. Border Patrol in 1985. Since joining, he has served in a variety of leadership roles in the CBP. Notably, Viteiello became Chief of the United States Border Patrol on February 1, 2017.

The current Acting Commissioner of CBP is Kevin K. McAleenan [link]. On March 30, 2017, President Trump nominated McAleenan to be the Commissioner of CBP [link]. Accordingly, if confirmed, McAleenan will be the Commissioner rather than the Acting Commissioner. McAleenan has extensive experience in the CBP and in its legacy agencies. He served as the Deputy Commissioner of CBP from November 2, 2014, to January 20, 2017, when he became Acting Commissioner.

Senate Confirms Rod Rosenstein as Deputy Attorney General

On April 25, 2017, the United States Senate confirmed Rod Rosenstein as the new Deputy Attorney General by a vote of 94-6. Rosenstein will replace Dana Boente, who had been serving as Acting Deputy Attorney General, as the number two official in the Department of Justice [see blog].

Rosenstein's background is detailed on the Department of Justice website [link].

Rosenstein served in the United States Attorney's Office for the past 26 years. Before being confirmed as Deputy Attorney General, Rosenstein served as the United States Attorney for the District of Maryland since 2005. He was the only United States Attorney appointed by President George W. Bush to serve in the same capacity throughout the entire administration of President Barack Obama.

Interestingly, in 2007, President Bush nominated Rosenstein to fill a vacant seat on the United States Court of Appeals for the Fourth Circuit. However, Rosenstein's nomination stalled in the United States Senate and never reached a vote.

Rosenstein graduated from Harvard Law School. Before beginning his service with the Department of Justice, he clerked for Judge Douglas H. Ginsburg of the United States Court of Appeals for the District of Columbia Circuit.

As the top deputy to Attorney General Jeff Sessions, Rosenstein will play a key role in developing and implementing Department of Justice policy over the coming years. This is significant in the immigration context to the extent that the Department of Justice plays a critical role in our immigration system. Rosenstein has impeccable credentials for the position, and represents one of President Trump's strongest picks for a key post thus far.

Miami Asylum Office Moving to New Location

On June 5, 2017, the United States Citizenship and Immigration Services (USCIS) announced that the Miami Asylum Office is moving to a new location on the weekend of June 9, 2017. Accordingly, the Miami Asylum Office will be closed to the public from June 6 to June 20, 2017. The Miami Asylum Office will reopen to the public at its new location on June 21, 2017.

Starting on June 12, 2017, the new address of the Miami Asylum Office will be:

USCIS, IRIS, Records Division to Deploy National File Tracking System Release 11.9 on Friday June 9th-11th

I received a news alert from the United States Citizenship and Immigration Services (USCIS), Immigration Records and Identity Services (IRIS), Records Division.

The alert states that the IRIS is scheduled to deploy the National File Tracking System (NFTS) Release 11.9 on Friday, June 9-11, 2017. The deployment is scheduled between June 9th at 9:00 EST and June 11 at 5:00 PM EST. During that time, the NFTS will be unavailable. The USCIS will send an email alert to users once the deployment is completed.

The alert provides the following phone numbers for users who experience system issues after the NFTS Release 11.9 is completed:

  • USCIS Helpdesk (1-888-220-5228);
  • ICE Incident Coordination Desk for ICE users (1-888-347-7762); and
  • CBP Service Desk for CBP Users (1-800-927-8729) or via email at CBP.Technology.Service.Desk@cbp.dhs.gov

USCIS Completes H1B Random Cap Selection Process (Lottery) for Fiscal Year 2018

On April 7, 2017, the United States Citizenship and Immigration Services (USCIS) announced that it had already received enough H1B petitions to reach the statutory cap of 65,000 H1B visas for fiscal year (FY) 2018. It also announced that it had received a sufficient number of H1B petitions to meet the U.S. advanced degree exemption, more commonly known as the “master's cap” [see blog].

On April 17, 2017, the USCIS announced that it had completed its H1B cap random selection process for FY 2018 [link]. On April 11, 2017, the USCIS used its computer-generated random selection process, commonly known as the H1B lottery, to select petitions to meet both the 65,000 H1B cap for general-category petitions and the 20,000 H1B cap under the advanced degree exemption. The USCIS first conducted the H1B lottery for advanced degree exemption petitions. All unselected advanced degree exemption petitions were then placed in the general-category pool.

The USCIS will reject and return any H1B petitions with fee that were not selected, except petitions that were found to be duplicate filings.

The USCIS announced that it received 199,000 H1B petitions during the filing period. This represents a significant decline from FY 2017 and FY 2016, which each saw in excess of 230,000 H1B petitions filed during the same filing period.[1]

The USCIS reminded stakeholders that as of March 3, 2017, it has temporarily suspended premium processing for all H1B petitions for up to six months. This suspension remains in effect. Please see our full article to learn about the suspension and its effects [see article].

"Social Parasite Tax" in Belarus Sparks Protests Against the Lukashenko Regime

Over the almost 23-year reign of President Alexander Lukashenko — a throwback to the Soviet-era — the people of Belarus have had much to protest. Many brave individuals have marched against the oppressive policies of the Lukashenko regime in Belarus at great personal risk in recent years.

Belarus moved recently to enforce its annual $250 tax on individuals who work for less than 183 days per year. The tax, colloquially called “the tax on social parasites,” triggered a new wave of protests beginning in February. On March 13, 2017, James Carstensen of Conservative News Service reported that Lukashenko partially backed down in the face of the initial wave of protests, agreeing to suspend the implementation of the “social parasite tax” for one year [link].[1]

However, Lukashenko's mild concession did not satisfy many of the protesters. Carstensen noted that on March 12, 2017, after Lukashenko's concession, protesters in four cities took to the street to demand Lukashenko's resignation. Some, including Pavel Severinets, an opposition leader, were detained by the regime for their role in the protests. Journalists who endeavored to cover the marches were fined for “'taking part' in 'unsanctioned' rallies.”

The article reports that Lukashenko justified the tax by stating that an unemployed person “is a future criminal.” However, finding employment in Lukashenko's Belarus is perhaps easier said than done for many. Carstensen notes that Belarus's economy is in the midst of a severe recession, and that the average salary in Belarus has declined by 40% since mid-2014. The article notes that Lukashenko is moving to reduce Belarus's economic dependence on Russia to improve its economic situation. However, when one considers that one of Lukashenko's foremost credentials prior to rising to power in post-independence Belarus is having run Soviet collective farms, one must consider the possibility that there are more foundational issues at play than those that have occurred recently.

American colonists coined the slogan “no taxation without representation” in the buildup to the American Revolution. The immediate cause of the recent wave of protests was the imposition of the absurd “social parasite tax.” However, many in Belarus are not only marching against one nonsensical tax, but also for the principle that they are a people who deserve representation and liberty of they are to be taxed.

President Trump to Nominate Lee Francis Cissna for Director of USCIS

On April 8, 2017, President Donald Trump announced his intention to nominate Lee Francis Cissna as the new Director of the United States Citizenship and Immigration Services (USCIS) [link].

The White House press release details Cissna's background.

Cissna Is currently serving as a Director of Immigration Policy in the Office of Policy of the Department of Homeland Security (DHS). Cissna previously served in the Office of Chief Counsel at the USCIS. Cissna also served with the United States Department of State (DOS) as a Foreign Service Officer stationed in Haiti and in Sweden. In between his stints in government, Cissna worked as an attorney in private practice.

The Senate will likely consider Cissna's nomination in the coming weeks. If confirmed, he will replace Leon Rodriguez, who left office on January 20, 2017.

The current Acting Director of USCIS is James McCament, who took over on March 31, 2017 upon the resignation of the previous Acting Director of USCIS, Lori Scialabba. McCament will continue to serve as Acting Director of USCIS until a new Director is confirmed by Congress.
